At the same time, we present an overview of what needs to be prepared for the upcoming tax period.<\/p>\n<h2>Minimum corporate tax<\/h2>\n<p data-pm-slice=\"1 1 []\">Law No. 530\/2023 Coll. \u00a7 46b of the Income Tax Act reintroduces the concept of a minimum tax (similar to the tax licence last paid in 2017) for a corporate taxpayer, effective from January 1, 2024.<\/p>\n<p data-pm-slice=\"1 1 []\">This refers to the minimum tax to be paid by the taxpayer if the calculated tax liability in the <a href=\"\/tax-advisory\/\">tax return<\/a> is lower than the minimum tax amount set out in paragraph 2 of \u00a7 46b of the Income Tax Act, even if the taxpayer reports a tax loss or zero tax liability in the tax return.<\/p>\n<p data-pm-slice=\"1 1 []\">The obligation to pay the minimum tax is determined after deducting tax allowances according to \u00a7 30a (for recipients of investment aid) or \u00a7 30b (for recipients of incentives) and after crediting the tax paid abroad according to \u00a7 45 of the Income Tax Act.<\/p>\n<p data-pm-slice=\"1 1 []\">The amount of the minimum tax depends on the taxable income (revenue) achieved, with taxable income being determined based on the definition in \u00a7 2 letter h), i.e. income subject to tax and is not exempt from tax, as follows:<\/p>\n<table style=\"height: 315px;\" width=\"612\">\n<tbody>\n<tr>\n<td width=\"302\">\n<p style=\"text-align: center;\"><strong>Achieved taxable income (TI)<\/strong><\/p>\n<\/td>\n<td width=\"302\">\n<p style=\"text-align: center;\"><strong>Minimum tax amount<\/strong><\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"302\">\n<p style=\"text-align: center;\">TI \u2264 50 000<\/p>\n<\/td>\n<td style=\"text-align: center;\" width=\"302\">EUR 340<\/td>\n<\/tr>\n<tr>\n<td width=\"302\">\n<p style=\"text-align: center;\">50 000 &lt; TI<\/td>\n<td width=\"302\">\n<p style=\"text-align: center;\">EUR 3 840<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h3>How to reduce the minimum tax?<\/h3>\n<p data-pm-slice=\"1 1 []\">The Act allows the minimum tax to be applied <strong>at half the rate<\/strong> for a taxpayer whose average number of employees with disabilities for the tax period is at least 20% of the total average number of employees.<\/p>\n<h3 data-pm-slice=\"1 1 []\">When is the minimum tax not payable?<\/h3>\n<p data-pm-slice=\"1 1 []\">According to \u00a7 46b, paragraph 7 of the Act, situations when the minimum tax is not payable are listed exhaustively:<\/p>\n<ul>\n<li>a newly established taxpayer \u2013 for the tax period in which it was established,<\/li>\n<li>a taxpayer not set up or established for business purposes \u2013 e.g., interest associations of legal entities, professional chambers, civic associations, etc.,<\/li>\n<li>a taxpayer with the legal form of a general partnership (v.o.s.) \u2013 the exemption arises from the specific definition of the tax subject for such a taxpayer, whose income is taxed by withholding according to \u00a7 43,<\/li>\n<li>a taxpayer operating a sheltered workshop or sheltered workplace,<\/li>\n<li>a taxpayer in bankruptcy or liquidation.<\/li>\n<\/ul>\n<h2>Income tax rate for the year 2024 vs. 2025<\/h2>\n<p>The taxpayer, a legal entity, must monitor the amount of its achieved taxable income (revenues) in order to correctly determine the tax rate it will apply in its tax return.<\/p>\n<p>The following table provides an overview of the rates for each tax period.<\/p>\n<table style=\"height: 392px;\" width=\"650\">\n<tbody>\n<tr>\n<td width=\"201\">\n<p style=\"text-align: center;\"><strong>Tax period<\/strong><\/p>\n<\/td>\n<td style=\"text-align: center;\" width=\"201\"><strong>Achieved taxable income (TI)<\/strong><\/td>\n<td width=\"201\">\n<p style=\"text-align: center;\"><strong>Tax rate<\/strong><\/p>\n<\/td>\n<\/tr>\n<tr>\n<td width=\"201\">\n<p style=\"text-align: center;\">2024<\/p>\n<\/td>\n<td style=\"text-align: center;\" width=\"201\">(TI) \u2264 60 000<\/td>\n<td style=\"text-align: center;\" width=\"201\">15 %<\/td>\n<\/tr>\n<tr>\n<td width=\"201\">\n<p style=\"text-align: center;\">2024<\/p>\n<\/td>\n<td style=\"text-align: center;\" width=\"201\">(TI) &gt; 5 000 000<\/td>\n<td width=\"201\">\n<p style=\"text-align: center;\">24 %<\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<h2>Micro-taxpayer<\/h2>\n<p data-pm-slice=\"1 1 []\">The micro-taxpayer status was introduced into the law with effect from January 1, 2021, and applies to both natural persons and legal entities.<\/p>\n<p>With effect from January 1, 2024, the taxable income threshold for determining the status of a micro-taxpayer is increased to <strong>EUR 60 000<\/strong>. We would like to point out that starting from January 1, 2025, this amount does not change to EUR 100 000 and therefore does not copy the amount of taxable income for determining the tax rate, as was the case before.<\/p>\n<p>Other conditions for achieving micro-taxpayer status are:<\/p>\n<ul>\n<li data-pm-slice=\"1 1 []\">the taxpayer <strong>is not<\/strong> a dependent according to \u00a7 2, letters n) to r), and <strong>does not carry out<\/strong> controlled transactions during the tax period,<\/li>\n<li>it <strong>has not been declared<\/strong> bankrupt, <strong>entered<\/strong> into liquidation or been granted a repayment plan,<\/li>\n<li>its taxable period <strong>is not<\/strong> less than 12 consecutive calendar months, except for a taxpayer who has a shorter taxable period due to death.<\/li>\n<\/ul>\n<p data-pm-slice=\"1 1 []\">If a legal entity meets the above conditions for the tax period 2024, it can benefit from the following advantages:<\/p>\n<ul>\n<li data-pm-slice=\"1 1 []\">preferential depreciation of tangible assets,<\/li>\n<li>tax loss deduction up to the amount of the tax base,<\/li>\n<li>simplified inclusion of allowances for bad debts into tax expenses,<\/li>\n<li>depreciation of receivables into tax expense up to the amount of the allowance to the extent that it would have been expensed in the <a href=\"\/accounting\/\">accounts<\/a>.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><span lang=\"en\" style=\"color: #808080;\" tabindex=\"0\">The information above on this website is intended to give you a basic overview of tax, accounting, and legal regulations.
